JUSTICE ADVISORY GROUP (JAG)

Role in PNG's National Law & Justice Program

The Government of Papua New Guinea (GoPNG) is committed to improving the performance of the law and justice sector, and to promote the rule of law in order to realise its broader development goals. AusAID has agreed to support this commitment by providing assistance through the establishment of a Justice Advisory Group and the introduction of the new Law and Justice Sector Program.

Justice Advisory Group

The Justice Advisory Group (JAG) has been established to provide independent technical advice to the GoPNG and AusAID on the performance of the law and justice sector, including the impact and outcomes of GoPNG and donor funding. The JAG will provide specialist technical advice in relation to policy, management and/or operational matters.

The JAG works closely with all law and justice sector agencies, being the judiciary (national, supreme, magistrates and village courts, and the NJSS), the police (RPNGC), correctional services (CS), Department of Justice & Attorney-General (DJAG) and related agencies to provide advice and assistance to improve the coordination of sector performance. 

Role of the JAG

The JAG does, as a part of its role supporting the law and justice sector,

    1.  Provide independent advice to support GoPNG in its role of sector monitoring and evaluation of performance of the law and justice sector, including impact and outcomes of GoPNG and donor funding.       
    2. Advise on policy, structural, financial or other issues for the law and justice sector
    3. Provide specialist technical advice in relation to policy, management and/or organisational matters
    4. Assist in the promotion of sector coordination and monitoring, the development of agreed sector outcomes and indicators, and the collection of sector performance information.

The JAG is a shared GoPNG/AusAID resource, which provides sectoral information and policy advice, and focuses on monitoring the performance of the law and justice sector as a whole. In particular, the JAG:-

    • Assists GoPNG to develop sector outcomes, and advise on qualitative and quantitative performance indicators
    • Assists GoPNG to collect sector performance information
    • Identifies key policy issues emerging from a Sector Performance Framework
    • Contributes to periodic reviews of sector performance
    • Contributes to independent reviews of AusAID's projects and programs
    • Builds capacity of both GoPNG and AusAID to undertake sectoral monitoring.

Law and Justice Program

The JAG works with the Law and Justice Sector Program (Program), which is the primary mechanism for AusAID to support PNG's law and justice sector. The objectives of this program are to strengthen the efficiency and effectiveness of the formal justice system and to support the informal system as an alternative avenue for the redress of disputes consistent with the National Law & Justice Sector Policy and Plan of Action.

The program has established a design framework for providing assistance primarily through PNG's own systems to the law and justice sector, including imprest account funding, technical assistance, infrastructure, training, procurement of materials and equipment, disbursement of grants and support for community-based initiatives.

The program approach was designed in 2003 and is now being implemented over the next 5-year period - and beyond - to improve sectoral coordination, improve functioning of the formal law and justice agenda, increase focus on crime prevention and restorative justice, and improve integration of cross-sectoral issues.

The JAG is tasked to appraise the program designs, plans and activities of the program manager (including the Program Design Document and Annual Program Plans), and monitor performance and compliance with contract requirements in order to achieve the goals and objectives of the program.

The JAG comprises a small team of independent experts managed by Educo, a specialist development organisation having extensive experience working in PNG.

The Origin of the Law and Justice Sector Working

The establishment of the Law and Justice Sector Working (LJSWG) was an initiative by the Department of National Planning Office in 1997 after a joint PNG/AusAID review in the same year.

The LJSWG comes under the auspices of the then Department of the National Planning office now the Department of National Planning and Rural Development to under take a Sector coordination role that will link with other donors and stakeholders.

The membership of the LJSG includes the Department of Justice and Attorney General, the Royal Papua New Guinea Constabulary, PNG Correctional Services, Ombudsman Commission, Magisterial Services and the National Judicial Staff Services.

The LJSWG major role is to Plan, and prioritise programs within the sector and  to develop policies and guidelines entailing broad sector development.

Information Management, Monitoring and Evaluation Technical Working Group (IMMETWG)

When was IMMETWG formed?

The Information Management/Monitoring and Evaluation Technical Working Group (IMMETWG) was established on 4th November 2003 with the primary objective of enhancing communication and collaboration within the law and justice sector for this technical area.

What is its Role?

Its main role is to coordinate the collection and analysis of data for the Performance Monitoring Framework focusing on the ten sector priorities.   The Performance Monitoring Framework will be the main tool to assist in monitoring the performance of the law and justice sector.   It is proposed to review the terms of reference at a later stage to integrate some elements of monitoring and evaluation into it.

The terms of reference are as follows:

  •  Overseeing the coordination/collection/compilation of law and justice sector data
  • Review current agency data/information linkages and data exchange
  • Review of law and justice sector IT situation, and the possible establishment of a law and
    justice sector information management policy/strategy
  • Development of sectoral indicators and the delivery of sectoral performance monitoring report
  • Identifying information management/monitoring and evaluation training needs and capacity
    building assessment(s)

Sub-Committee

Due to the broad composition of the members, IT and Data sub-committee were formed to represent the specific requirement of the members.  Work is in progress in developing an IT standard for the sector.

The website committee was formed in the middle of the year to consult with the stakeholders on the design of the website and progress it to completion.   Members on the committee initially comprise representatives of the IMMETWG but the group was later expanded to cater for media personnel from the sector agencies.

Key Milestone

By the end of the year, the IMMETWG would have held twelve meetings and three workshops in 2003 and 2004.   The series of meetings and workshops has assisted the sector to produce the following outputs:

The Performance Monitoring Framework has undergone four stages of iterations.   The fourth version has 61 indicators focusing on the ten priorities and involves primary and secondary data collection.   The Performance Monitoring Framework will be further refined based on the completed version of the sector strategic plan and the final version presented at the annual JAG stakeholder workshop in 2005.

Linkages to Access to Laws TWG

The Access to Laws TWG was established in the middle of the year.   Its main purpose is to make PNG laws and other legal material readily available to the public through the publication and distribution of the text of PNG statutes, case laws and court judgments. The publication is to be done in both hard and electronic copies.

It has established linkages with the IMMETWG for exchange of information.   Some members of the IMMETWG are also members of the Access to Laws TWG and vice versa and regularly attend the meeting.
